PatientCare Terms of Service

Welcome to PatientCare. These Terms of Service ("Terms") govern your access to and use of the PatientCare website, mobile applications, and related services (the "Services"). By creating an account, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1.Who we are
PatientCare is operated by DAWA AFYA MEDICAL TECHNOLOGIES CC, registered in Namibia (the "Company"). We provide a digital platform that connects patients with licensed healthcare professionals for virtual consultations, bookings, prescriptions, and related healthcare management.
2.Nature of the Service (no medical practice)
PatientCare itself does not practice medicine or provide medical advice. All clinical services are delivered by independent, licensed healthcare professionals ("Doctors") who are solely responsible for the medical care they provide. In emergencies, call local emergency services immediately.
3.Eligibility
- You are at least 18 years old or have verifiable parental/guardian consent.
- You provide accurate, complete registration information and keep it updated.
- You comply with applicable Namibian laws and regulations.
- Doctors must hold valid registration with the Health Professions Councils of Namibia (HPCNA) or a recognised equivalent and may be required to submit verification documents.
4.Accounts and security
- You are responsible for safeguarding your login credentials and for all activity under your account.
- Notify us immediately of any suspected unauthorised use or security breach.
- We may suspend or terminate accounts for suspected fraud, misuse, or violations of these Terms.
5.Appointments, prescriptions and limitations
- Consultations may occur via video, audio, or messaging, depending on availability.
- Prescriptions are issued at a Doctor's sole discretion, subject to legal and clinical requirements.
- Availability of specific services may vary by location and time; we may modify or suspend features without notice.
6.Fees and payments
You agree to pay all fees shown to you at checkout in Namibian Dollars (NAD). Payments are processed by third-party providers (e.g. Buddy, Finatic, Flutterwave). We act as an intermediary to facilitate payments between patients and Doctors. Taxes may apply. You authorise us and our payment partners to charge your selected method of payment.
7.Health information and privacy
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and share personal and health information. By using the Services, you consent to our data practices described there. We implement appropriate technical and organisational measures to protect personal data, but no system is completely secure.
8.User responsibilities
- Provide truthful, accurate medical history and information.
- Do not misuse the Services, interfere with their operation, or attempt unauthorised access.
- Do not post or transmit unlawful, harmful, or infringing content.
9.Doctor responsibilities
- Maintain valid professional registration and comply with all clinical, legal, and ethical obligations.
- Protect patient confidentiality and securely handle health information.
- Use the Services only for lawful, professional purposes.
10.Intellectual property
The Services, including software, interfaces, designs, text, graphics, and trademarks, are owned by the Company or its licensors and are protected by law. You may not copy, modify, create derivative works of, distribute, or reverse engineer any part of the Services except as permitted by law or with our prior written consent.
11.Licence to user content (non-health)
For non-health content you upload (e.g. reviews, support messages), you grant the Company a worldwide, non-exclusive, royalty-free licence to use, reproduce, and display such content for operating and improving the Services, subject to our Privacy Policy.
12.Disclaimers
- The Services are provided "as is" and "as available" without warranties of any kind.
- We do not warrant uninterrupted, secure, or error-free operation.
- Clinical outcomes depend on Doctors and the information you provide, not on the platform.
13.Limitation of liability
To the maximum extent permitted by law, the Company will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our aggregate liability arising out of or relating to the Services shall not exceed the amounts you paid (if any) in the three (3) months preceding the event giving rise to liability.
14.Indemnity
You agree to indemnify and hold harmless the Company from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your misuse of the Services, violation of these Terms, or infringement of third-party rights.
15.Termination
You may stop using the Services at any time and request account deletion (subject to legal retention obligations). We may suspend or terminate access immediately for violations of these Terms or misuse. Upon termination, your right to use the Services ceases, but certain sections (e.g. intellectual property, liability) will continue to apply.
16.Changes to the Services or Terms
We may update the Services and these Terms from time to time. If changes are material, we will provide notice (e.g. in-app notice or email). Your continued use after the effective date of changes constitutes acceptance of the updated Terms.
17.Governing law and disputes
These Terms are governed by the laws of the Republic of Namibia. You agree to the exclusive jurisdiction of the courts of Windhoek, Namibia for any disputes arising out of or relating to these Terms or the Services.
